MyABH Loyalty Terms and Conditions


1.    General Terms and Conditions - Definitions for the Program 
1.1.
    MyABH Loyalty Program (“Program”) of the company under the name “ATHANASIOU PRIVATE MEDICAL CLINICS – PRIVATE M.H.N. – PLASTIC – DERMATOLOGICAL APPLICATIONS MEDICAL ANONYMOUS COMPANY” and with the distinctive title “ΑTHANASIOU MEDICAL S.A. ABH (Athens Beverly Hills) Medical Group”, which is seated in Glyfada, Attica (96 Vouliagmenis Avenue, 16674) (“Company” or “we”), is a program of benefits, offers, rewards and services to the participants of the Program (“Members”), through the collection and redemption of points (“Points”). It is clarified that “Point” means the unit of measurement used in the Program.
1.2.    These terms and conditions of the Program (“Terms”) regulate the legal relationship between the Company and the Members, the way of participation in the Program and the way of collection and redemption of Points with benefits (“Benefits”) and rewards (“Rewards”). These Terms may be amended unilaterally by the Company at any time, in its sole discretion, without prior notice. The Company shall notify Members of any changes to the Terms by posting them in a subsequent edition of these Terms. Any changes shall take effect immediately upon their posting and the issue of a relevant notice in relation to such changes. The continuous use of the Program implies the Members’ agreement to the Terms, as in force from time to time.
1.3.    Within the framework of the Program, the Company notifies the Members of the rules, terms and conditions for the collection, transfer and redemption of Points with offered services and products. The rules for collecting, retaining, redeeming and generally managing the Points are determined exclusively by the Company. The Company reserves the right to change the above data unilaterally and at any time, without any prior notice. In case of any change in the rules regarding the Points, the changes will be immediately communicated to the Members via the website https://abh-medicalgroup.com/en and the relevant printed materials of the Company. 
1.4.    The Program is not applicable (neither for collection nor for redemption nor for transfer of Points) with respect to the Bio-Regenerative Wellness services of our ΖΟΕ Clinics. The Program is also not applicable in case of any prohibition or restriction by law.
1.5.    The Company has the right, at its sole discretion and without any prior notice, to cancel all Points, offers and membership of a Member, if such Member does not comply with these Terms and Conditions and the rules of proper use of the Program.
1.6.    Points are collected, retained, redeemed and transferred solely and exclusively in accordance with the Terms and Conditions of the Program, as applicable from time to time, as well as with applicable legislation. Any other use, transfer, sale, assignment, exchange or promotion of the Points by a Member or any third party is expressly prohibited.
1.7.    Points that have not been collected or retained in accordance with the Terms and Conditions of the Program are automatically cancelled and cannot be redeemed. These Points shall be deducted from the Member's account.
1.8.    The Company reserves the right to monitor the proper use of the Program by a Member throughout the duration of the Member's participation in the Program.
1.9.    If a Member breaches any of the Terms and Conditions of the Program, the Company may, at its sole discretion, immediately exclude such Member from any current or future offer of the Program, suspend and/or terminate his/her participation in the Program and cancel all Points collected by this Member under the Program. In any case of unlawful use of Program Points and/or violation of any term of the Program, the Company reserves all its legal rights, including its right to raise claims and to seek remedy before the competent courts and authorities.


2.    Participation - Registration in the Program 
2.1.
    All natural persons over the age of eighteen (18) are eligible to participate in the Program. Legal entities of any form, companies of any kind and sole proprietorships do not qualify for membership.
2.2.    The registration to the Program is done through a MyABH Loyalty invitation sent to the interested client via SMS to his/her mobile phone number. The interested client opens the link received for the registration to the Program and follows the steps of registration and verification of his/her data, until the completion of his/her registration as a Member of the Program, by opening his/her personal account (“Account”) with a password of his/her choice. Upon completion of his/her registration, the Member receives the (digital) MyABH Loyalty Card, which he/she can store in his/her digital wallet.
2.3.    If the Member does not complete his/her registration in accordance with clause 2.2 above, he/she will not be able to participate in the Program, collect, redeem and transfer Points.
2.4.    Participation in the Program is strictly personal through each Member's Account and the Account may not be transferred or assigned by the Member to any third party. Moreover, each Member may only maintain one personal Account, to which all Points collected by that Member are credited. If there are two or more Accounts corresponding to one Member, only the first and oldest of such Accounts (with the Points collected therein) shall be retained, whereas any additional Accounts (and the Points collected in those Accounts) shall all be cancelled.
2.5.    Each Membership Card is individual, cannot be transferred or assigned to any third party and bears the name of the beneficiary Member. The Card remains at all times property of the Company, which reserves the right, at its absolute discretion, to withdraw, cancel and/or replace it with another Card. The Card is not a credit card.
2.6.    By registering to the Program, the Member fully and unconditionally accepts these Terms, as well as the Company's Privacy Policy  and Cookie Policy, which form an integral part of these Terms. Where required by law, we may seek your consent at a later time.
2.7.    Each Member who registers to the Program shall maintain the confidentiality of his/her Account, user data and password, and keep all these data up-to-date, complete, accurate and true. By opening an Account using someone else’s data, the person opening the account declares that he/she has the authority to bind the other person as a Member to these Terms. Moreover, to the extent this person does not have the authority to bind another person as a Member to these Terms, he/she agrees to be bound personally by these Terms and assumes liability for any damages that may be caused by any misuse of the Account resulting from such access or use. 
2.8.    If a Member wishes to terminate his/her participation in the Program, he/she must submit a request through the Program. Upon completion of the un-subscription process within the Program, the Member's Account, Card and Points will be automatically cancelled.
2.9.    The Account, Card and Membership Points are automatically cancelled in the event of the Member’s death.


3.    Program Levels
3.1. 
   MyABH Loyalty Program consists of three (3) levels (“Program Levels”): Exclusive, Elite and Ambassador, which are determined by the Points collected in the Member's Account within a period of twelve (12) months from the time of the last transaction with the Company. This is a “rolling period”, which is always calculated from the time of the last transaction with the Company. Thus, the Points have a “rolling expiry date”, which is calculated from the date of their collection, provided that they have not been redeemed in the meantime.  
3.2.    The Program Levels are as follows:

3.3.    The number of Points required for each Program Level and the benefits and rewards of the Members of each Program Level may be changed at any time by the Company, without prior notice.
3.4.    Regarding new Members, their Points shall be calculated upon their registration to the Program, according to the purchases they have made of the Company's services and products throughout the twelve (12) months prior to their date of registration to the Program.
3.5.    Both upon registration to the Program and upon each Level upgrade, the Member shall receive a relevant notification by email.
3.6.    A Member may earn Points by referring “friends” - new Members, provided that the following conditions are cumulatively met:
3.6.1.    The suggested “friend” is not already a client of the Company;
3.6.2.    The suggested “friend” will register to the Program as a new Member, noting at the time of registration the mobile phone number of the Member who made the referral, in order to establish the connection between the “friends”; and 
3.6.3.    The suggested “friend” will make at least one purchase after his/her registration.
If all above conditions are met, upon completion of the registration of the new Member - “friend” of an existing Member, the new Member will automatically be registered as a “referral” of the existing Member. Thus, upon completion of the first transaction of the new Member - “friend”, the existing Member who referred him/her will earn Points due to the referral.


4.    Redemption of Points
4.1. 
   Points may be redeemed within twelve (12) months from their acquisition.
4.2.    If the Member fails to redeem his/her Points within twelve (12) months from their acquisition, the Points shall expire and shall be deducted from the Member's total Points. In this case, a systemic check shall be performed and the Member's Program Level shall be recalculated. If after this calculation the Member has no Points to redeem, then he/she shall automatically participate in the first Program Level, i.e. he/she becomes an Exclusive Member.
4.3.    Points can be redeemed either by using a gift voucher (“Gift Certificate”) to purchase any service chosen by the Member, or by purchasing our specific redeemable services.  
4.4.    There are three (3) types of Gift Certificates, depending on their value, i.e. Gift Certificates of fifty (50), one hundred (100) and two hundred (200) euros. Each Member may redeem a total of three (3) Gift Certificates per year, i.e. one Gift Certificate of €50, one Gift Certificate of €100 and one Gift Certificate of €200. It is clarified that the year is calculated starting from the date when the registration to the Program is completed and the relevant Member becomes a Member.
4.5.    The redemption of Points cannot be combined with any other benefit/offer of the Company.
4.6.    Points can only be redeemed once for each service. In particular:
4.6.1.    Each Member may only use one (1) Gift Certificate per service, i.e. when redeeming Points using a Gift Certificate, each Member can choose to use only one (1) Gift Certificates for each service of his/her choice. No more than one Gift Certificate can be combined to purchase a single service of the Member's choice. 
4.6.2.    Each Member may purchase through the redemption of Points only one specific redeemable service of ours. Two or more redemptions cannot be used simultaneously on one service.
4.7.    It is expressly forbidden to use the services and products acquired by redeeming Points, with the purpose of further use of these services or products in any way against consideration.


5.    Transfer of Points 
5.1. 
   Each Member may freely transfer any number of Points to another Member of the Program, without any limitation.
5.2.    In case of transfer of Points from one Member to another, the Points collected by the Member - sender of the transferred Points and determining his/her Program Level are not affected. However, upon completion of the transaction, the available redemption Points of that Member - sender will be reduced, while the available redemption Points of the Member - recipient of the transferred Points will be increased accordingly.
5.3.    The transfer of Points cannot be cancelled after completion. Consequently, the value of the transaction is non-refundable.
5.4.    The transfer of Points can only be made online, after the Member has logged in his/her Account in the Program. It is clarified that additional information may be requested for verification during and/or after the transaction is completed.


6.    Governing Law - Jurisdiction
These Terms are governed by Greek law. The Courts of Athens have exclusively jurisdiction to resolve any dispute arising from or in connection with these Terms.
